Training Description

Disciplining students with autism presents challenges for school personnel, as these students have the right to FAPE under IDEA. Inappropriate discipline can violate students' rights and the IDEA. Additionally, students with autism are protected from discrimination under Section 504 and Title II of the ADA, regardless of IDEA eligibility. This presentation will cover best practices in discipline procedures and how to avoid violations of IDEA, Section 504, and the ADA.

Training Objectives

1. To discuss the ways in which disciplining students with autism can violate the IDEA, Section 504, and Title II of the ADA.

2. To present eleven keys to disciplining students with autism that avoid violating these laws.

3. Permissible actions when students with autism present a danger the themselves or others.

About the Presenter

Mitchell L. Yell, Ph.D., is the Fred and Francis Lester Palmetto Chair of Teacher Education and a Professor in Special Education at the University of South Carolina. He earned his Ph.D. from the University of Minnesota. His professional interests include special education law, IEP development, and progress monitoring. Dr. Yell also serves as a State-level due process review officer (SRO) in South Carolina.
